"Violation of contract" vs. "Producer's Gapjil"…"Actual Singer 2" Concert, Legal Dispute Over Copyright Contract

The production company and the agency have entered a legal dispute over the rights contract for the performance of "Actual Singer 2"


Crea Studio (hereinafter referred to as Crea), the producer of MBN's "Actual Singer 2" ahead of its first broadcast, claims that nCH Entertainment (hereinafter referred to as nCH) violated the contract, saying, "I handed over the performance rights contract to a third party," and nCH confronts, "I have not violated the contract."

Crea said, "We terminated the joint business contract, deposited 4.4 billion won in investment to be returned, and the contractual relationship with nCH was terminated."

"We are considering strict legal measures for nCH's unauthorized sale of the rights to perform the 'Korea-Japan King' show," he said. It is also in a position to produce its own "Actual Singer 2" concert.

However, nCH countered that "the sale of performance rights in the contract is a valid contract," and that the contract was unilaterally terminated. It is explained that even Crea knew about selling some of the copyrights.

nCH protested, saying, "After five months of contract, when we forced an agreement to terminate the contract and refused it, we have unilaterally notified the cancellation of the concert and management contract," adding, "It is a production company's power trip."

According to nCH, while preparing for the performance for four months in consultation with Crea, Crea belatedly asked to write a contract. However, Crea notified him of the termination of the contract within a week.

Above all, the nCH argued that Crea's self-preparation for the "Actual Singer 2" concert was also a violation of the contract, as the breach of contract was a one-sided claim. Accordingly, legal measures such as prohibition of performances will be taken.


The nCH said, "We proceeded with consultation with Crea about all the terms and conditions of the contract in advance, but belatedly took all the losses due to Crea's change of mind."

In response, nCH filed a criminal complaint against CEO Seo Hye-jin of Crea on charges of obstruction of business and credit damage.
